1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the BuildingHub platform, mobile applications, and the buildinghub.io website (together, the “Services”), operated by BuildingHub, Inc. (“BuildingHub”, “we”, “us”). By accessing or using the Services you agree to these Terms. If you use the Services on behalf of a company or property, you represent that you have authority to bind that entity, and “you” refers to that entity.

2. The Services

BuildingHub provides building-operations software, including work-order management, preventative maintenance, certificate-of-insurance tracking, access and visitor management, leasing analytics, and amenity booking. Features available to you depend on your organization’s subscription and the role assigned to you by your organization’s administrator.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@buildinghub.io of any unauthorized use. We may suspend accounts that compromise the security or integrity of the Services.

4. Acceptable use

You agree not to: (a) use the Services in violation of applicable law; (b) attempt to gain unauthorized access to any system or data; (c) interfere with or disrupt the Services; (d) upload malicious code; (e) resell or sublicense the Services without our written consent; or (f) use the Services to store or transmit content that is unlawful or infringes the rights of others.

5. Customer data

As between the parties, your organization owns the data it submits to the Services (including work orders, tenant directories, visitor logs and documents). You grant us the rights needed to host, process and display that data to provide the Services. Our handling of personal data is described in the Privacy Policy.

6. Third-party services

The Services interoperate with third-party systems (for example Yardi, Genea, LenelS2, HID, Apple Wallet, Amano McGann, Stripe, Twilio and Mailgun). Your use of those systems is governed by their own terms, and we are not responsible for third-party services we do not control.

7. SMS & messaging

When you opt in to SMS notifications, we will send a message confirming your signup. You can cancel at any time by replying STOP, after which we will send a final confirmation of your unsubscription. Reply HELP for assistance. Message delivery depends on your carrier, and carriers are not liable for delayed or undelivered messages. Message and data rates may apply; contact your wireless provider with questions about your plan.

8. Fees

Subscription fees, billing cadence and payment terms are set out in your organization’s order form or subscription agreement. Amounts payable are exclusive of taxes unless stated otherwise.

9. Intellectual property

The Services, including software, design and content (excluding your data), are owned by BuildingHub and its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription for your internal business purposes.

10. Disclaimer & limitation of liability

The Services are provided “as is” to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free. To the maximum extent permitted by law, neither party will be liable for indirect, incidental or consequential damages, and our aggregate liability under these Terms is limited to the fees paid for the Services in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Termination

Either party may terminate as set out in the applicable subscription agreement. Upon termination, your organization may export its data for a period of thirty (30) days, after which we may delete it in accordance with our retention practices.

12. Changes

We may update these Terms from time to time. Material changes will be notified through the Services or by email, and the “Last updated” date above will change. Continued use after changes take effect constitutes acceptance.
